EB-1B is an employer-sponsored immigration visa petition under the first preference where labor certification is not required. It is designed for a researcher or professor.
To qualify for EB-1B, an alien worker must have an employer as a petitioner and must work in an academic field of sciences, arts, business, education or athletics. Also he or she must be recognized internationally as outstanding, reflected in at least two of a list of criteria as below, and must have at least three years of experience in teaching or research in his or her field of endeavor. The employer can be a university, or a private company that has at least three full-time researchers and has documented accomplishments.
The regulatory criteria include: (1). Receipt of major prizes or awards in recognition of excellence in an academic field; (2). Membership in associations in his or her field that require outstanding achievements of their members; (3). Published materials in professional publications about alien's work; (4). Participation as judge for others’ work; (5) Original contributions of major significance to his or her field; (6) Authorship of scholarly or scientific articles in a journal with international circulation.
Recommendation letters and a well-drafted attorney’s petition letter play a critical role. In addition, a well-organized index along with supportive and objective evidence will make a case easy to understand and smooth to get approved.
